Property listing terms
Important: These website terms are a preliminary framework, not a substitute for legal advice. The online form is not a binding contract. Both parties must review the documentation and sign the final agreement before services begin.
1. Scope of services
PaiPah publishes property information, coordinates enquiries and viewings, and supports negotiations. It has no authority to sell, transfer title, receive money or sign on behalf of an owner unless separately and lawfully authorised.
2. Agreement type and term
The standard draft is a non-exclusive listing for 180 days. Owners may sell independently or use other agents but must keep PaiPah informed of the status. A buyer introduced by PaiPah who completes a transaction during the term or within 180 days after expiry is treated as an introduced prospect under the agreement.
3. Commission
Commission is 3% of the actual sale price stated in the sale or transfer agreement, payable upon completion and payment or registration of transfer as specified in the final agreement. Applicable taxes and expenses must be stated separately.
4. Owner responsibilities
- Provide evidence of ownership or authority to list, and disclose co-owners, spousal interests, mortgages, leases, disputes, boundaries, access and use restrictions.
- Confirm that information and photos are accurate and authorised for use, and promptly report changes, price adjustments, reservations or a sale.
- Do not place contact details in text or photos, or bypass PaiPah when dealing with prospects introduced by PaiPah.
5. Publication and suspension
PaiPah may edit the presentation, redact personal information, request further evidence, or reject, suspend or remove listings that may be unlawful, misleading, incomplete or disputed. No sale or timeframe is guaranteed.
6. Buyers and due diligence
Buyers are responsible for verifying title, boundaries, encumbrances, access, permits, buildings, taxes, source of funds and ownership restrictions, especially for foreign buyers. Independent lawyers, surveyors and other professionals should be consulted before any payment or contract.
7. Data protection
Owner contact details are not public. PaiPah shares information with relevant parties only as necessary for coordination and lawful verification. See the privacy notice for details.
8. Termination and disputes
Termination, approved expenses and treatment of existing prospects must be specified in the signed agreement. Thai law applies. The parties should seek an amicable resolution before litigation unless the law provides otherwise.
Before commercial listing services begin, the final version must be reviewed by a Thai lawyer and the relevant licences and business registrations checked.
